Software - Software JMP: Keine zentrale Beschaffung und Verteilung von Lizenzen

--- English version below --- Es wird künftig keine zentrale Beschaffung und Verteilung von Lizenzen der Software JMP an der RWTH geben. Hintergrund hierzu ist, dass JMP nicht mehr dem Unternehmen SAS angehört und nun neue Lizenzbedingungen und -strukturen einführt. JMP Statistical Recovery LLC wird künftig keinen Vertrag mehr mit der RWTH Aachen abschließen, die aktuelle Lizenzperiode läuft noch bis zum 29.06.2025. Bei der zentralen Prüfung der Vertragsbasis und der Rahmenbedingungen sind unter anderem folgende Mängel festgestellt worden: 1. JMP Statistical Recovery LLC, mit dem Nutzende einen Vertrag eingehen, ist derzeit nicht durch das EU-US Data Privacy Framework Programm zertifiziert. 2. Es besteht das Risiko, dass ohne Vorankündigung Unterauftragnehmer auch außerhalb der EU eingesetzt werden. 3. Sollte es erforderlich sein, dass Studierende die Software für ihr Studium nutzen, ist eine freiwillige Nutzung nicht möglich, da ein Konto angelegt werden muss. In Anbetracht dieser gravierenden Mängel empfehlen wir dringend, von einer Nutzung der Software JMP abzusehen! Eine zentrale Beschaffung über den Software-Shop oder per BANF ist somit nicht mehr möglich. ------------------------------------------ There will no longer be any central procurement or distribution of JMP software licenses at RWTH in the future. The reason for this is that JMP is no longer owned by SAS and is now introducing new license terms and structures. JMP Statistical Recovery LLC will no longer conclude a contract with RWTH Aachen; the current license period remains in effect until June 29, 2025. During the central review of the contract basis and the framework conditions, among others, the following deficiencies were identified: 1. JMP Statistical Recovery LLC, with which users must enter into a contract, is currently not certified under the EU-US Data Privacy Framework program. 2. There is a risk that subcontractors outside the EU may be used without prior notice. 3. If students are required to use the software for their studies, they cannot do so on a voluntary basis, because creating an account is mandatory. In light of these serious deficiencies, we strongly advise against using JMP software! Consequently, central procurement via the software shop or by BANF is no longer possible.
